These terms apply to your use of perfometrics.co and to purchases of digital products from our shop. The website is operated by Perfometrics UG (haftungsbeschränkt), Berlin ("Perfometrics", "we", "us"). Our full company details are in our Impressum.

Our agency services (for example SEO, paid media or consulting) are not sold through this website. They are always agreed in a separate written proposal or contract, and those terms apply to them.

1. Using this website

The content on this website is general information about marketing and our services. It is not advice for your specific situation, and results described on the site are not a promise of results for your business. We take care to keep the content accurate and current, but we cannot guarantee that it is complete or always up to date.

All texts, graphics, designs and other content on this website belong to Perfometrics or are used with permission. You may view and share links to our pages, but you may not copy, republish or sell our content without our written permission.

You may not use the website in a way that harms it or other users, for example by attempting to break its security, overloading it, or scraping it at scale.

Our website contains links to other websites. We have no control over their content and are not responsible for it.

2. Digital products

Contract. The products in our shop are an invitation to order. When you place an order, you make an offer to buy. The contract is concluded when we confirm your order by email or deliver the product, whichever comes first. The contract language is English.

Prices and payment. Prices are shown at checkout. For consumers in the EU, prices include VAT. Payment is processed by the payment providers offered at checkout.

Delivery. Digital products are delivered electronically, usually by download link or email immediately after payment. If you do not receive your product, contact contact@perfometrics.co and we will resend it.

Licence. When you buy a digital product, you receive a personal, non-transferable right to use it for yourself or within your own business. You may not resell, share, publish or distribute it, in whole or in part, without our written permission.

3. Right of withdrawal for consumers

If you are a consumer (you buy for purposes outside your trade or profession), you have the following right of withdrawal.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Perfometrics UG (haftungsbeschränkt), c/o Andrej Zafirov, Bernkasteler Straße 7, 13088 Berlin, Germany, email: contact@perfometrics.co, phone: +49 151 10767411) of your decision to withdraw from this contract by a clear statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but you do not have to. To meet the withdrawal deadline, it is enough to send your notice before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we will refund all payments we received from you without undue delay and no later than 14 days from the day we receive your notice of withdrawal. We will use the same payment method you used for the original purchase, unless expressly agreed otherwise. You will not be charged any fees for this refund.

Early expiry of the right of withdrawal
For digital content not supplied on a physical medium, your right of withdrawal expires once we have started the supply (for example by sending you the download link), provided that you have expressly agreed that we begin before the end of the withdrawal period and have confirmed that you know you lose your right of withdrawal as a result.

4. Warranty

The statutory warranty rights apply to our digital products.

5. Liability

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are only liable if we breach an obligation that is essential for the proper performance of the contract and on which you may regularly rely. In that case our liability is limited to the typical, foreseeable damage. Otherwise, our liability for slight negligence is excluded.

6. Governing law and jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not remove the protection given to you by the mandatory laws of the country where you live. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.

7. Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

8. Changes

We may update these terms for the future, for example when our offering or the law changes. The terms that apply to a purchase are those in force when you placed your order.
